Terms and Conditions: Membership Terms of Choke Athletics GmbH


  1. Member Services and Rights

Within the scope of their booked plan, members are entitled to take part in the corresponding martial arts and fitness offerings during the relevant class and opening hours, and to use the strength training area (from age 16). Current training and opening hours, as well as short-notice changes or cancellations, are communicated via the website www.choke-athletics.de (or the current domain), the official social media channels, and/or the app. Members are advised to check for possible changes before visiting the studio. Choke Athletics GmbH reserves the right to adjust the class schedule, opening hours, or scope of services.


  1. Physical Fitness for Training

By concluding the membership, the member confirms that there are no health concerns preventing participation in training. In case of doubt, medical advice should be obtained before starting training. Choke Athletics GmbH accepts no liability for health consequences resulting from a member's lack of physical fitness for training.


  1. Contract Term and Termination

Cancellations must be submitted in text form (email or letter). The notice period is one month before the end of the respective contract term. The contract ends automatically upon expiry of the agreed contract term, without requiring notice of termination. A right to extraordinary termination exists in particular in the case of a proven relocation (upon presentation of a certificate of registration) and in the other cases governed by these Terms and Conditions.


  1. Fees and Payment Method

Membership fees are paid exclusively via SEPA direct debit. Payments are initiated by Choke Athletics GmbH and collected monthly in advance, on the 1st of each month. If membership begins after the 1st of a month, the pro-rata fee for the month of joining is collected immediately upon conclusion of the contract. The registration fee is debited together with the second regular monthly fee. If the member falls into arrears with two full monthly fees, access to the training area may be denied. In this case, Choke Athletics GmbH is entitled to immediately demand payment of all outstanding fees up to the end of the initial contract term.

  1. Liability

Choke Athletics GmbH and the trainers acting on its behalf are liable for damages arising from injury to life, body, or health resulting from a negligent or intentional breach of duty, as well as for other damages resulting from a grossly negligent or intentional breach of duty. Beyond this, liability is excluded to the extent permitted by law. No liability is assumed for valuables brought onto the premises; members are advised to keep personal belongings secure at all times.


  1. Changing Plans During the Contract Term

Switching to a plan with a longer term or greater scope of services is possible at any time. Switching to a plan with a shorter term or reduced scope of services (e.g., from "Unlimited" to "2x per week") is only permitted following proper termination at the end of the current contract term.


  1. Plan-Bound Use and Age Groups

Participation in classes is limited to the offerings included in the respective plan and the associated age group. Participation in classes outside the booked age group is not permitted. The following age groups are indicated in the class schedule:

Kids and teens (ages 7–16): marked "Kids" or "Teens"
Adults (from age 17): no separate marking


  1. House Rules and Code of Conduct

The published house rules for training operations, as well as the instructions of trainers and studio staff, form a binding part of these membership terms. Every member agrees to comply with the house rules, to behave respectfully toward other members, trainers, and staff, and to follow the instructions of studio staff.

In the event of violations of the house rules, Choke Athletics GmbH reserves the right, depending on the severity of the violation, to: issue a warning, impose a temporary access ban with a suspension of the contract, or terminate the membership contract immediately and without notice.

Choke Athletics GmbH has a right to immediate termination without notice in particular in cases of serious or repeated violations of the house rules, physical altercations, threats, discrimination, harassment, or any conduct that significantly impairs or endangers training operations, other members, or staff. Fees already paid will not be refunded in these cases.


  1. Illness and Periods of Rest

Temporary absences or interruptions to training do not, as a general rule, exempt the member from the obligation to pay fees. In the event of illness, the contract may be paused upon presentation of a medical certificate. The certificate, stating the specific period, must be submitted via the contact form on the website within two weeks at the latest; certificates submitted late can no longer be considered. Non-illness-related periods of rest of three months or longer may be requested upon presentation of suitable evidence. The paused period is automatically added to the original contract term.


  1. Operational Closures and Force Majeure

Short-term or operational closures on individual days do not exempt the member from the ongoing obligation to pay fees, provided that reasonable alternatives are offered (e.g., rescheduling or a comparable class offering). If the provision of certain services is not possible due to force majeure, there is no claim to compensation or replacement sessions.


  1. Validity, Severability, and Jurisdiction

The contract becomes effective upon signature by the applicant and acceptance by Choke Athletics GmbH. There are no oral or written side agreements; amendments and additions must be made in text form. Should individual provisions of this contract be or become invalid, the validity of the remaining provisions shall remain unaffected; invalid clauses shall be replaced by the applicable statutory provisions. To the extent permitted by law, the place of jurisdiction is Berlin.

Note on the right of withdrawal: For contracts concluded in person at the studio, there is no statutory right of withdrawal. If the contract is concluded via distance selling (e.g., online), the statutory right of withdrawal under Sections 355 et seq. of the German Civil Code (BGB) applies; corresponding withdrawal instructions will be provided separately in that case.


  1. Participation Requirements for Martial Arts Classes

Participation in martial arts classes requires compliance with the provided "Class and Sparring Requirements Handbook" as well as the age limits applicable to the respective plan. Participation in classes outside one's own age group is not permitted. In the case of late arrival, the lead trainer is entitled to deny access to the ongoing class for safety reasons.


  1. Studio Access

The membership contract is personal and non-transferable. Passing on the access card to third parties is prohibited and may result in immediate termination in accordance with Section 8.


  1. Hygiene

Members agree to use the provided disinfectant dispensers and disinfect their hands before entering the training areas. In addition, general hygiene requirements must be observed (e.g., use of one's own towel, clean training clothing, indoor shoes).


  1. Access Bans

In the event of violations of these Terms and Conditions or the house rules, Choke Athletics GmbH is entitled to impose temporary access bans. During such a ban, the contract is suspended free of charge; the original contract term is extended by the corresponding period. The right to extraordinary termination under Section 8 remains unaffected.
